Terms of service

INTRODUCTION

Throughout the site, the terms “we”, “us”, and “our” refer to joujoubotanicals.com and JouJou. This website is available, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. The seller is JouJou vl. Nikolina Firm (sole proprietor, hereinafter referred to as JouJou), and the buyer is a visitor to this site who fills in an electronic order, sends it to the seller, and makes payment by credit card or any other form of payment accepted on the site.

GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. Your content (excluding credit card information) may be transferred unencrypted and may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the service, use of the service, or access to the service or any contact on the website through which the service is provided, without express written permission from us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these terms.

ORDERING

The customer orders the product or products via an electronic order form. A customer is considered to be any person who electronically orders at least one product, fills in the required information, and sends the order. Prices are expressed without shipping costs, which are calculated at the end of the purchase. Goods are ordered electronically by clicking on a specific product and adding it to the basket. While we carefully track our stock inventory, there is always a possibility that some products may run out of stock.

In the unlikely event that your order is out of stock, we will contact you to inform you, and you will have the option to wait for the new batch, choose another product, or receive a refund. The goods are considered ordered after the buyer receives a confirmation email. If the visitor or user does not have an email address, enters an incorrect one, or for technical reasons cannot receive an email, the seller is not obliged to attempt to inform the user about the order or any other details related to the order (delivery, payment, refund, complaint, etc.).

SECURITY OF PAYMENT

We accept most major debit and credit cards, including MasterCard, American Express, Maestro, Visa, and Diners. Your card data is safe; confidential information is transmitted via a public network in a secure (encrypted) form using SSL protocols and PKI systems, according to up-to-date cryptographic technology. Our payment provider partner, Stripe, ensures complete confidentiality of your card data from the moment you use the payment form. Payment information is forwarded encrypted from your web browser to the bank that issued your card. Our store never comes into contact with complete information about your payment card.

For buyers in Croatia, payment can also be made on delivery (COD - cash on delivery). As COD orders come with additional costs that we do not transfer to the customer, if an order is not accepted, this payment method will no longer be available for future orders. The payment method can be selected when creating the order and cannot be changed later. Buyers in Croatia can also pay by bank transfer. With this type of payment, the package will be sent after the payment is settled in our balance account. Please note that items are reserved for 1 business day with bank transfer payments. If the payment is not received within that time frame, we reserve the right to cancel the order. A cancellation notice will be sent to the email address provided at checkout.

INVOICE DELIVERY

Invoices are sent to you via email to the email address used at checkout.

DELIVERY

Your order will be shipped out within 1-3 working days. We aim to use the fastest delivery options so you receive your package asap. Still, delivery time will vary depending on your location. If you have any questions about your order, please contact us at info@joujoubotanicals.com.

If you do not receive the goods within a reasonable timeframe, please contact us so we can assist you in locating your shipment. In the event that a buyer does not accept delivery of the goods ordered and the order is returned to the seller, the seller reserves the right to request reimbursement from the buyer for all costs associated with the delivery. Furthermore, if a buyer who previously refused delivery re-orders the same goods through the JouJou webshop, the seller retains the right to decline processing the new order. Additionally, the seller may charge the buyer for the delivery costs incurred from the previous shipment of the uncollected goods.

SHIPPING ISSUES

We take pride in our products, as well as our packaging. Every package will be sent out in perfect condition, and we expect our partners to deliver it in the same manner to you. If the goods are damaged during delivery and the buyer has a reason for complaint due to delivery issues, this should be immediately reported directly to the delivery person. Unfortunately, the seller will not be able to accept complaints related to transport and delivery that are reported after the delivery is finished.

Nevertheless, if you have any complaints or in case of damaged goods, please send us a photo along with your complaint to info@joujoubotanicals.com, and we will do our best to resolve the issue.

PRE-ORDERS

When a product is available for pre-order, it will be shown on the product page. Orders with pre-ordered items will be shipped once all products are available.

REFUNDS

At JouJou, we are happy when you are happy. That’s why we offer a 30-day No-Matter-What Guarantee and stand behind every product we make. You can find detailed information in the Refund section in the website footer.

RIGHT TO COMPLAIN

If you are dissatisfied for any reason, you can file a complaint with JouJou via email at info@joujoubotanicals.com. To address your issue promptly, please include the invoice number, your name, and your surname. We aim for customer satisfaction, so we are confident that we will resolve any complaints to mutual satisfaction. JouJou reserves the right to change these terms and conditions. The buyer is responsible for the accuracy of the data entered at the time of purchase. If you notice an error on the page, please email us at info@joujoubotanicals.com so we can correct it as soon as possible. 

STATEMENT OF RESPONSIBILITY

We do not assume any responsibility for how you use the product. Product descriptions are not medical advice nor advice for diagnosing or treating preexisting medical conditions. The publications stated on the JouJou webshop or our social media may not be considered a sufficient basis for making medical, personal, financial, or business decisions. JouJou does not guarantee that the photos of the product fully match the appearance of the product itself. Though all descriptions are checked regularly and in detail, we are not responsible for possible unintentional errors in the product description.

GIFT CARDS

Gift Cards can only be purchased online and can only be redeemed on www.joujoubotanicals.com. The Gift Card can be used to pay for the full value or part of the value of the selected products and/or services. The Gift Card cannot be redeemed against the purchase of another Gift Card. If a purchase is not completely covered by a Gift Card, an additional payment method as offered on the site can be used to complete the purchase. Gift Cards are not redeemable for cash.

When purchasing a Gift Card on the JouJou webshop, the Gift Card will be sent to the selected email address you provide for the recipient or directly to the buyer (if the “Send to me” option is selected), immediately after the purchase is completed or on the selected date. JouJou will not be liable for failure or delay in delivery. The buyer is obliged to provide a correct email address for delivery. If the provided email address cannot be confirmed, JouJou reserves the right to withhold the delivery of the Gift Card.

A Gift Card expires automatically once its balance has been exhausted. A Gift Card may not be topped up with additional funds. A Gift Card is valid for two (2) years after the date of purchase. The expiration date is stated in the email containing the Gift Card. After the expiration date, the Gift Card cannot be used for a purchase, cannot be reactivated, and the remaining value cannot be reimbursed. JouJou has no obligation to remind or inform the buyer or the recipient of a Gift Card’s expiry, and it is the sole responsibility of the holder to ensure that any balance is used in full prior to expiry.

The client (buyer or recipient) is obliged to retain an expired Gift Card in the event the client wishes to return a purchase. Any products or services paid for using a Gift Card that are subsequently returned for a refund will be credited to the existing or a new Gift Card. If the total to be refunded is more than what was paid using a Gift Card, the remaining refund balance will be refunded to the other payment method used by the client (e.g., credit/debit card or other payment methods such as PayPal). JouJou cannot be held liable for Gift Cards that are lost or stolen. We advise treating the Gift Card as cash. Gift Cards remain the property of JouJou, who maintains the right to cancel the card in its sole discretion in situations where it is deemed necessary to do so (such as to comply with applicable laws or as a result of circumstances beyond its control).

COUPONS

All coupons provided on the JouJou webshop are intended for individual use and cannot be combined with other coupon offers, unless explicitly specified otherwise.

GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Croatia.
